These Terms & Conditions (“Terms”) govern your use of the website and rental services provided by Abston Hauling & Rentals (“Company,” “we,” “our,” or “us”). By accessing this website or renting equipment from us, you agree to these Terms.

If you do not agree to these Terms, please do not use our services.

1. Rental Agreement Controls

All trailer rentals require execution of a separate Rental Agreement prior to release of equipment.

The Rental Agreement governs rental duration, payment terms, deposit requirements, damage responsibility, insurance requirements, and equipment use rules. In the event of a conflict, the signed Rental Agreement controls.

2. Eligibility (18+ Requirement)

You must be at least 18 years old to rent equipment or use our services. By using our website or services, you represent that you are 18 years of age or older.

3. SMS Communications Terms

By providing your phone number through our website, booking forms, or by contacting us directly, you consent to receive SMS messages from Abston Hauling & Rentals for the following purposes:

Rental confirmations

Delivery and pickup notifications

Appointment reminders

Customer service communications

Review requests

Service-related updates

Message frequency varies.

Message and data rates may apply.

You may opt out of receiving text messages at any time by replying:

After sending STOP, you will receive a confirmation message and will no longer receive SMS communications unless you opt in again.

4. Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier and is not guaranteed.

5. Equipment Use & Responsibility

The renter agrees to:

Operate equipment in a safe and lawful manner

Not exceed weight capacity

Properly secure all loads

Not sublease or transfer equipment

Not transport hazardous materials

Not use equipment for illegal purposes

The renter assumes full responsibility for equipment during the rental period.

6. Assumption of Risk & Indemnification

Trailer rental and towing involve inherent risks. By renting equipment, the renter assumes all risks associated with use.

The renter agrees to indemnify, defend, and hold harmless Abston Hauling & Rentals from any claims, damages, losses, or expenses (including attorney fees) arising from misuse, negligence, or violation of these Terms.

7. Payments, Deposits & Charges

Rental fees and deposits must be paid as outlined in the Rental Agreement.

Additional charges may apply for:

Late returns

Damage

Excess cleaning

Violations of rental terms

8. Limitation of Liability

To the fullest extent permitted by law, Abston Hauling & Rentals shall not be liable for indirect, incidental, or consequential damages arising from equipment rental or website use.

Total liability, if any, shall not exceed the rental fee paid.

9. Website Use

You agree not to misuse this website or attempt unauthorized access to systems or data.

We reserve the right to refuse service for violations of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the appropriate courts located in Madera County, California.
